Your use of the Site means that you agree to these Terms & Conditions and constitutes a binding agreement between you and Punk Rave Australia.

Do not use the Site if you do not agree to these Terms & Conditions in their entirety. References in these Terms & Conditions are exclusive to "Punk Rave Australia", "we," "us" or "our" means Punk Rave Australia. "Account holder", "user", "member", "the customer", "the client" means You.

We may at our sole discretion change, add, update or delete portions of these Terms & Conditions at any time. It is your responsibility to check these Terms & Conditions for changes prior to use of the Site, and in any event your continued use of the Site following the posting of changes to these Terms & Conditions constitutes your acceptance of any changes.

Privacy Clause

Respecting and protecting the privacy of users of https://shop.punkrave.com.au (the "Site") is of great importance to us at Punk Rave Australia. This notice describes our policies of information collection and our use practices with respect to the Site, and highlights choices you may have about the way we use and share such information. Please read and understand this policy so that you can understand how we use your personal information.

Please be aware that if you use the Site, register in any fashion in connection with the Site, or participate in a survey, contest, sweepstakes, or other promotion available on the Site, you are agreeing to both terms of our Terms & Conditions and Privacy Policy set forth elsewhere on the Site, each as in effect from time to time. Please also be aware we reserve the right at our discretion to make changes to this policy at any time, and all such changes shall be immediately applicable.

Merchandise

Please keep in mind that while Punk Rave Australia offers exclusive Punk Rave merchandise in varying sizes for sale on the Site, we cannot guarantee availability at a particular time. We reserve the right to change our merchandise offerings and stock quantities at any time. We also reserve the right to change content, features and offerings, pricing and sales, and adjust accessibility of the Site at our discretion.

RMA Process

RMA (Return Merchandise Authorisation) items must be returned to Punk Rave Australia in the same manner in which they were dispatched with the original packaging intact and undamaged, swing tags attached to garments and the garment/s unwashed and free of evident use ie: cigarette smoke, makeup, lipstick, perfume, wear & tear, etc... Please refer to our Minimum Return Standards stated below.

Should we receive an authorised RMA return that has evidence of wear and use, original packaging is torn and/or damaged, hang tags missing, etc... we will deduct the cost of replacing the packaging and swing/hang tags from your refund. If the garment has been worn and/or used, we will return the garment to the customer at the customer's expense. No further action will take place.

100% Happiness Promise

Punk Rave Australia offers a conditional 100% Happiness Promise to our customers. If you are not completely satisfied with your purchase you may return the item to us for a full item purchase price store credit. We only accept return requests that are submitted through our website. All return requests must be submitted within 14 days of your item being shipped out. We do not accept return requests on any item after 14 days.

When submitting your return request through our website, please select "100% Happiness Promise" as reason for return. You will be asked for a detailed reason why you wish to return your item under our 14 Day Happiness Promise. Please complete this area thoughtfully.

Our 100% Happiness Promise does not cover:

  • Sale Items
  • Discontinued Items
  • Clearance Items
  • Drop-Ship items

Please use our dedicated Return's page - link located in the footer of our website or through your "My Account" page to send us a request for 100% Happiness Promise Return. For orders shipped Internationally, we do not accept return requests unless the item is faulty.

When submitting a return request, please select 100% Happiness Promise as the reason for returning your garment. You will be required to submit a valid reason as to why you are asking to return your purchased item for refund. Please complete this thoughtfully.

All 100% Happiness Promise requests for refund must be action in the following way:

  1. 100% Happiness Promise return request submitted via our website
  2. 100% Happiness Promise request approved and RMA allocated to customer
  3. You must follow the instructions as outlined in your RMA email when posting your item to us
  4. We receive the item and notify you via email that we are in receipt of your returned item
  5. We review the item for resaleability
  6. If the item meets our standard return guidelines, we will approve the 100% Happiness Promise refund request
  7. We will issue you a full item purchase price in-store credit for you to spend at our store in any manner you wish

Our in-store credit can be used on regular price items, Sale Items, Clearance Items, Pre-Order items and Drop-Ship items.

Shipping charges are non-refundable.

In all cases, the garment must meet our acceptable return standards. Please read our Return Standards noted above to ensure your garment meets our return policy guidelines.

Change Of Mind

Punk Rave Australia offers Change Of Mind service on Australian stock only. We do not offer or accept change of mind on:

  • Clearance items
  • Discontinued items
  • Sale items
  • China drop-ship items

Please use our dedicated Return's page - link located in the footer of our website or through your "My Account" page to send us a request for Change Of Mind Return. For orders shipped Internationally, we do not accept return requests unless the item is faulty.

When submitting a return request, please select Change Of Mind as the reason for returning your garment. You will be required to submit a valid reason as to why you are asking to return your purchased item. Once your request has been approved to ship to us, you will receive a detailed email with instructions on how to return your garment.

All Change Of Mind requests for refund must be actioned in the following way:

  1. Change Of Mind return request submitted via our website
  2. Change Of Mind request approved and RMA allocated to customer
  3. You must follow the instructions as outlined in your RMA email when posting your item to us
  4. We receive the item and notify you via email that we are in receipt of your returned item
  5. We review the item for resaleability
  6. If the item meets our standard return guidelines, we will approve the change of mind return 
  7. We will issue you a full item purchase price in-store credit for you to spend at our store in any manner you wish

Our in-store credit can be used on regular price items, Sale Items, Clearance Items, Pre-Orders and Drop-Ship orders.

ZipPay & LayBuy Returns

Australian customers may request to return an item purchased through ZipPay or LayBuy providing such request is submitted to us within 14 days of your item being shipped out.  Any return request submitted past our 14-day Happiness Promise timeline will not be approved.

A ZipPay or LayBuy request for return is actioned in same manner as any other request to return an item through our website: 

  1. Submit your request to return via our website and select "ZipPay Return or LayBuy Return"
  2. Please provide a reason why you wish to return your ZipPay or LayBuy item. Please complete this area thoughtfully.
  3. We will approve your request and issue you a RMA number
  4. Please follow the detailed instructions as set out your RMA email for return posting of item
  5. We receive the item and notify you via email that we are in receipt of your returned item
  6. We review item for resaleability. If the item meets our standard return guidelines, we will approve the change of mind return request
  7. We will issue you a full item purchase price in-store credit for you to spend at our store in any manner you wish

Size Exchange Requests

We understand that online shopping can be a bit of a nightmare sometimes, particularly when it comes to choosing the right size. Punk Rave Australia offers a No Fuss Size Exchange program that will take the frustration out of online shopping.  Should you require a different size, you can drop us a request for size exchange using our Returns link in the footer of our website or through your "My Account" page. Please be aware that while we are happy to provide a different size, all shipping costs associated with Size Exchange Requests is at the customer's expense.

All Size Exchange Requests fall under our RMA Standard Policy. We cannot provide a size exchange if the garment has been worn or does not meet our minimum returns policy. When requesting a size exchange, you cannot ask for a different item. Size exchange must be an identical item of different size from what you purchased. Should we not have the new size available in our Australian based warehouse and/or the item is out of stock overseas, we will offer you in-store credit to the value of the purchased item. Original shipping costs and return shipping costs are non-refundable.

Drop Shipping Services - China Based Items

Punk Rave Australia provides direct to customer's doorstep drop-shipping services for Punk Rave apparel held in Punk Rave Co. Ltd. warehouse. We now offer Free Shipping from China to any destination in the world for shopping carts sub-total greater than A$150.00. 

  1. Free shipping is offered on China based drop-shipping items providing the sub-total of your shopping cart is greater than A$150.00
  2. Change-Of-Mind return requests is not granted on China based items
  3. 100% Happiness Promise does not include China based items
  4. Size Exchange Requests are always honoured
  5. Punk Rave Australia is not liable for any International Duties or taxes or Custom Charges associated with International Orders and/or Size Exchange

Please kindly understand our terms before purchasing a drop-ship item.

Clearance & Discontinued Items

All clearance and discontinued items are final.

We do not offer size exchange, change-of-mind returns, refunds, in-store credit on any clearance or discontinued item. Please read the allocated size chart for each item before purchasing. Size charts can be found on the individual product page under the main product image. Size charts are provided as an additional product image. Alternatively you can use the Size Chart link in the footer of our website.

If you have doubts about the garment's size, please use our live chat box located in bottom right hand corner of your browser or you can use our contact form located in the footer links. If your clearance item has a manufacturing fault, we will allocate a RMA number so we can resolve this issue fast. Please read our RMA Policy above to determine how to contact us and our guidelines for returning items.

Free Shipping is not offered on Clearance or Discontinued items. The markdown for clearance items are below cost price and therefore we cannot offer free shipping as well. Please kindly understand. Please read our shipping information page for more information.

RMA Policy : 100% Happiness Promise or Size Exchange or Change-Of-Mind Returns

  1. The customer must contact us to express intent to return the item within 14 days of delivery. Please use our dedicated Return's page - link is located in the footer of our website or through your "My Account" page.
  2. A RMA number is issued to the customer. It is the responsibility of the customer to ensure the RMA number is placed on the outside of the shipping package in a highly visible position. Punk Rave Australia does not accept any returns without an authorised RMA number visible on the package.
  3. The item is shipped to us at the customer's expense. Our 100% Happiness Policy, Change Of Mind Returns and/or Size Exchange Program is for the item's full purchase price and does not include original shipping costs. Punk Rave Australia does not refund shipping costs incurred by the customer at time of purchase or when returning the item under our 14 Day Return Policy.
  4. The returned item is sent to us in the same condition in which it was dispatched, with the original packaging intact and undamaged, swing tags attached to garment and the garment is free of evident use.
  5. Punk Rave Australia will grant a in-store credit to the value of your purchased item price within 3 business days. 
  6. To receive in-store credit, the item must be returned to us within 14 days of delivery. Please include a photocopy of your invoice with your return item. We cannot accept a return request without evidence of purchase.
  7. In the event we receive a return item under our 100% Happiness Policy and/or Change Of Mind Request and it does not meet our minimum standards for acceptable returns (ie: no proof of purchase, no allocated RMA, and/or signs of obvious wear and tear) we will contact the customer via email and/or telephone to discuss our reasons for refusing the refund. We will also organise acceptable shipping carrier/services for the return of the item at the customer's expense.
  8. We do not offer change-of-mind returns, 100% happiness promise, in-store credits, monetary refunds or size exchange requests on Clearance and Discontinued items. Please understand our policy before purchase.
  9. We do not offer change-of-mind returns or 100% happiness promise on any drop-ship item. Please understand our terms before purchasing.

Punk Rave Australia retains the right to refuse all 100% Happiness Returns and/or Change Of Mind Refund Requests on a case by case basis.

RMA Policy : Manufactured Faulty Goods

Should you discover a manufacturing fault on your item, please contact us via our dedicated Return's page - link located in the footer of our website or through your "My Accounts" page so we can discuss with you best course of action. Punk Rave Australia will not accept any item return without an authorised RMA number. When contacting our Returns Dept it is important that you provide detailed information regarding the manufacturing flaw so we can assist you quickly.

Punk Rave Australia will process a manufacturing fault request strictly on an case by case basis. We will:

  1. Allocate a unique RMA Number for the return of the faulty item. Punk Rave Australia will not accept receipt of merchandise without an authorised RMA Number and proof of purchase (scanned & printed copy of invoice).
  2. You will need to send the faulty item, plus a copy of your Invoice receipt, plus a copy of your return shipping charge receipt, together in the one package to Punk Rave Australia within 7 days of RMA allocation for visual inspection. A scanned copy of the shipping invoice/receipt is required to obtain a full shipping cost refund. We cannot refund shipping costs if we do not have proof of shipping purchase. Punk Rave Australia is not responsible for any duties or taxes associated with the return of any item.
  3. We cannot approve a refund for any faulty manufactured item/s without sighting the fault in person. Photographs are not sufficient when determining course of action.
  4. Should your garment have a manufacturing fault, we ask that you return the garment to us so we may return it to the manufacturer.

Your Consumer Rights Under Australian Law

It's important that as a consumer you are aware of your rights under Australian Law. For further reading, please visit: Consumer Rights and Guarantees

  1. Should you receive a manufactured faulty garment, you have two options available to you. You can;
    • Receive a Full Refund to the value of the faulty item, plus original shipping cost, plus return shipping costs (when you send the faulty item back to us) inclusive of postage packaging or ;
    • You may request a replacement item to be sent out to you. Should you request a replacement item instead of a full refund, you will be required to still send us the faulty item, and in return, we will send out an identical replacement garment (same style number, colour and size) and provide you with a refund of the return shipping costs as matched by your shipping receipt.
  2. Please Note: If a replacement item is not available, Punk Rave Australia will provide a full invoice refund to the value of: the faulty item, original shipping cost and return shipping cost via your method of payment.

All RMA items returned to Punk Rave Australia are the responsibility of the customer. Punk Rave Australia cannot be held accountable or liable if the item goes 'missing in the mail' or 'lost in transit'. It's important that the customer uses tracking facilities when shipping garments to us. Punk Rave Australia is not liable for any custom duties, fees, charges or taxes in association with return items.

Pricing

Punk Rave Australia offers two currencies for our customers in the form of: Australian dollars (AUD) & US dollars (USD). Australian customers will be shown Australia Pricing only. You cannot change currencies even out of curiosity. All International customers will be shown US Dollar pricing.

Our prices are subject to change without notice. For International customers, there may be duties and taxes owing when purchasing from our store. You will be responsible for these additional charges upon delivery and they are not included in your order total. Punk Rave Australia cannot provide an estimate of duties and/or taxes as such duties and/or taxes differ from country to country. If you are concerned about the duties and taxes, please contact your government custom's authority to confirm prior to purchase.

ZipPay is only available to Australian Customers. PayPal Credit is only available to US Customers. LayBuy is available to Australian, New Zealand and UK residents only.

Please be aware that all accounting procedures (acceptance, rejections) of ZipPay, LayBuy and PayPal Credit is at ZipPay, LayBuy and PayPal Credit's sole discretion. Punk Rave Australia does not have any authority or persuasion with either Buy Now, Pay Later solution. For payments using Credit Cards, we do not store credit card information on our website or servers. All credit card payments are through Braintree secure gateway or PayPal. All payments are (AUD) Australian Dollars for our Australian customers and US Dollars (USD) for International customers.

Cancellation of Order

We cannot cancel any online order that has been sent to our warehouse for dispatch. This usually takes place within 60 minutes of customer online purchase.

In the event that you wish to cancel your order for items shipped directly from Punk Rave Co. Ltd. warehouse, we will accept the request for cancellation providing we receive your email request within 2 hours of order payment. Any request for drop-ship order cancellation received after this time will be refused. Once your order has been forwarded to Punk Rave Co. Ltd. International Exporter, we are unable to cancel the order. Please kindly understand.

Delivery

The delivery times provided by Punk Rave Australia are estimates only. Punk Rave Australia will not be held accountable for late deliveries or loss or damage relating to late deliveries. In the event that multiple items are ordered, part deliveries may be made where stock is available. All reasonable attempts to notify you will be made using the details you provide. Please ensure you enter the correct email & delivery address. Punk Rave Australia cannot be held responsible for incorrectly entered email or delivery addresses.

For domestic orders, we use Australia Post Services. Australia Post offers SMS or email notifications with their services. When you consent to use Australia Post's SMS or email notifications, you consent to provide personal information for the direct purpose of delivering your order/s.

For Drop-Shipping Orders, we use DHL, EMS or UPS, depending on your Country destination, and if your address is considered 'remote' or 'rural' by the International carrier. Tracking is available as standard for all Australia Post services except for Air Economy and Ship By Sea. By accepting these terms and conditions you consent to your personal contact information (SMS or email) being released to Punk Rave Co. Ltd., Australia Post, DHL, EMS & UPS (if applicable) for the purpose of providing you with notifications pertaining to the progress of your order(s). This service is offered for the benefit of the customer and can be stopped at any time.

International Customs Charges

Some International orders may incur a customs or import duty charge. Punk Rave Australia does not have any control over these charges nor are we able to advise what they will be, as it is based on the regulations & compliance of your country. For further information, please contact your local customs office. All charges are to be paid by the customer on delivery of order. Punk Rave Australia is not liable for any duties, custom fees or taxes pertaining to importing or exporting International orders.

Intellectual Property

The Site contains copyrighted material and other information proprietary to Punk Rave Australia, its licensees and licencors, and other third parties.

Except as otherwise permitted by law, you may not copy, modify, publish, distribute or otherwise exploit any content (including, but not limited to, text, logos, trademarks, trade names, service marks, images, graphics, photographs, video recordings, music, media, or software) on the Site (collectively, the “Content”) without the express consent of Punk Rave Australia and any other relevant rights owner, except that you may download Content for your personal non-commercial use only, so long as you keep intact all of the copyright and other proprietary notices.

The Site as a whole, and the arrangement of Content thereon, is copyrighted and owned by Punk Rave Australia, and we reserve all rights not expressly granted here-under.

Under no circumstances are our stock inventory images and size charts allowed to be used and/or displayed and/or associated with: other retailer websites, eBay or mass 'group' selling forums or websites such as Etsy, etc. Those found to be exploiting our Terms will be contacted immediately and a 'stop release' request will be issued.

Fair Use

It is a violation of the law to place orders under a false intent to purchase, a false name or with a fraudulently obtained credit card. Fraudulent ordering will be prosecuted to the fullest extent the law allows.

The product information contained on this Site is provided by Punk Rave Australia in good faith. The information is believed to be accurate and current at the date the product information was placed on this Site.

Punk Rave Australia does not guarantee that your access to the network or the server which stores and delivers our website and its contents to you will remain free of viruses or other harmful components. By accessing the website you agree that Punk Rave Australia will not be held liable as a result of any error, virus or harmful component.

Neither Punk Rave Australia or employees of Punk Rave Australia make any representation or warranty as to the reliability, accuracy or completeness of the information contained on this Site, and by accessing this Site you agree that neither Punk Rave Australia nor any of the employees thereof will be liable for any errors or omissions in the information contained on this Site. Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our supplier, Punk Rave Australia shall have the right to refuse or cancel any order/s placed for product listed at the incorrect price. Punk Rave Australia shall have the right to refuse or cancel any such order/s whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Punk Rave Australia shall immediately issue a credit to your credit card in the amount of the charge through the same channels in which you purchased.
